Annulment at Diborsiyo sa Pilipinas

Nais namin dito sa Down Under Visa ng happy ending sa lahat ng aming mga kliyente ngunit hindi ito nangyayari sa lahat ng pagkakataon. May mga relasyong hindi nag wo-work out at nag fail. Kung kayo ay nasa ganitong sitwasyon, basahin ang mga sumusunod upang maliwanagan ang ilang bagay.

Una, kung na i-file na ninyo ang Permanent Partner Visa at hindi pa ito aprobado (Subclass 820 o Subclass 100), meron kayong legal na obligasyon na mag report sa Department of Immigration and Border Protection. Tumawag sa 131 881 o pumunta sa pinakamalapit na Australian Immigration Office at i-withdraw ang sponsorship. Labag sa batas ang hindi pag gawa nito. Huwag ninyong isipin “Oh kasi ayaw kung ako ang dahilan ng kanyang pagka deport.” Hindi kayo ang magpapasya sa bagay na iyon.

Pangalawa, kung ang visa ay hindi pa approbado, kailangan ninyong kontakin ang embassy para i-withdraw ang sponsorship. Sa ganitong paraan, hindi nyo lang ginagawa ang inyong legal na obligasyon, sigurohin din ninyo na hindi ma approve ang visa. Dahil pag nangyari yun, kailangan ninyong maghintay ng limang taon bago makapag sponsor ng panibagong applikante (Regulatin 1.20J sa Migration Regulations)

Ngayon sa annulments!

Alam ng karamihan na walang diborsiyo sa Pilipinas. Ang tanging paraan na wakasan ang isang kasal ay annulment lang, isang mahirap at mahabang proseso. Kung meron kayong iisponsoran galing sa Pilipinas na legally married pa, hindi ninyo siya pwedeng pakasalan at hindi rin kayo pwedeng mag apply ng Prospective Marriage Visa para sa kanya puwere na lang kung legally free to marry na siya. Kahit sabihin pa natin na siya ang pinaka masamang asawa dito sa mundo, at baka hindi na niya ito nakita sa loob ng 14 years, walang kinalaman ang issuing ito. Kahit saan man sa mundo, kasama na dito ang Pilipinas, ang pag aasawa ay isang legal na kontrata at naka tali siya dito.

Ang kasal ay pwedeng ipa-annul sa Pilipinas kung mai-establish ng babae o ng isang party o both parties na pareho silang walang psychological na kakayahan na maintindihan kung ano ang ibig sabihin ng marriage commitment, at yan ang puweding maging basihan ng korte na ideklarang annulled ang kanilang kasal. Ito ay mahabang proseso at mangangailan pa ng psychologists reports, at maraming mga evidensiya para mapatunayan na sila ay "psychological incapacity". At hindi pa sigurado ang kalalabasan nito. Pwedeng abutin ito ng isang taon o higit pa lalo na kung ang kabilang partido ay hindi nakiki pag-cooperate.

At ang mga abogado ay kilala na kaya nilang patagalin ang ganitong mga kaso lalo na pagnalaman na may isang mayamang Australianong involved.

Nag asawa ako ng isang Pilipina ngunit hindi nag-work out ang relationship. Kailangan ko ba ng annulment?

Isang karaniwang misconception na kapag kinasal sa Pilipinas, kailangan mo ring ipawalang bisa ang kasal na iyon sa Pilipinas.

Mali!

Sa ilalim ng batas ng Australia, pwede kang mag file ng divorce sa Australia para sa kasal na naganap sa ibang bansa at ang divorce na iyon ay "legally binding" o kinikilala ng batas ng Australia. At dapat kayong kumonsulta sa isang Family law specialist o abugado sa Australia. Hindi kami dito nagbibigay ng legal advice. At kung masusunod ninyo ang lahat na mga requirements para sa divorce duon sa Australia, then pwede ninyo itong gawin sa Australia sa ilalim ng "no fault" divorce law ng Australia. Mura at napaka simpleng proseso.

Kikilalanin ba ang divorce na ito sa Pilipinas?

Technically, oo. May probisyon sa Family Code ng Pilipinas na kinikilala ang diborsiyo sa pagitan ng mga Pilipino at mga dayuhan.

Ngunit…hindi madaling gawin na maiparehistro dito sa Pilipinas ang diborsyong ito at ang magpakasal uli dito sa Pilipinas.

Being married while you are still married is a crime in both Australia and in Philippines. You need to organise an annulment of your marriage, or you need to establish a de facto relationship. Let me know if you need help with this? Please complete a visa assessment form.

Hello po, Ako po ay matanong regarding po sa Diborsyo at Annulment. Kasal po ako dito sa Australia at pinarehistro ko ang aming kasal sa Pilipinas. Kapag po ba nagrant ang divorce ng aming kasal kailangan ko po ba magfile ng annulment sa Pinas?

I'm married in my country Philippines and haven't annul or divorced but my married life wasn't success and now I have a serious relationship to someone and his willing to help me and start a new life with him, his and Australian nationality but my problem is, what kind of visa which his going to apply in order to get me here in Hong Kong where I presently working I'm thinking to file a divorce application here in Hong Kong which I know is not acceptable in my country,, please need advice what to apply a visa without any hassle in applying in Australia and then if in case will be granted my visa to live in Australia am I can re marry again in Australia ?

The issue is about Australian immigration law and not about whether the Philippines recognises an HK divorce. If you are divorced in HK, I can't see a problem. Suggest you make enquiries about getting a divorce there, and then complete our online visa assessment form.

You can but it’s difficult. You need to speak to a Philippines attorney about that. It would be easier to marry inside Australia.

You need to consult an Australian lawyer who specialises in Family Law. I can't advise you about divorcing. But I can tell you that you can't marry in Australia if you are still married in Philippines.
