Changes to Australian Partner Visas in 2026

The old “tourist visa first, Partner visa later” strategy is no longer something Australian–Filipino couples should rely on for future Visitor visas. The Australian Government has announced that future Visitor visas will carry a No Further Stay provision, designed to prevent visitors from using a Visitor visa as a pathway to remain in Australia through another visa. For a Filipina girlfriend, fiancée or wife who wants to live permanently in Australia, the safer starting point is to assess the appropriate Prospective Marriage or Partner visa pathway before planning travel to Australia.
The 820/801 Partner visa pathway still exists, but the key question is no longer simply how to get your partner into Australia first. It is which visa pathway fits your relationship and circumstances under the new rules.
If you are an Australian man with a Filipina girlfriend, fiancée or wife, you may have noticed that advice about Australian partner visas seems to be changing rapidly lately.
One reason is the Australian Government's major September 2026 announcement concerning Visitor visas.
On 17 September 2026, the Government announced that future Visitor visas will have a No Further Stay provision. The stated objective is to stop people using Visitor visas as a pathway into another visa and remaining in Australia through a bridging visa.
For Australian–Filipino couples, this changes the way visa planning should be approached.
The old question
For many years, couples often started with:
“How do I get my Filipina girlfriend to Australia?”
The answer might have involved a Visitor visa.
Once she was in Australia, the couple might then have lodged the subclass 820/801 Partner visa.
This was attractive because the 820 is an onshore visa and the applicant must be in Australia when applying, and could remain on a bridging visa when the tourist visa stay ended.
But this approach depended on the applicant's visa conditions.
The new question
The more important question now is:
“Which visa pathway should we use to bring our relationship to Australia?”
That is a different way of thinking about immigration.
Instead of finding any possible way to get your partner physically into Australia first, the focus should be on the visa pathway that matches the relationship.
The main relationship pathways
For Australian citizens, permanent residents and eligible New Zealand citizens, Home Affairs has several relationship visa options.
Prospective Marriage visa — subclass 300
This is for a person who intends to marry their prospective spouse (fiancee).
The applicant must be outside Australia when applying.
Partner visa — subclasses 309/100
This is the offshore Partner visa option for eligible spouses and de facto partners.
The applicant must be outside Australia when applying for the 309. The 309 is the temporary stage toward the permanent 100.
Partner visa — subclasses 820/801
This is the onshore Partner visa pathway.
The applicant must be in Australia when applying for the 820.
The 820/801 pathway still exists.
The issue is whether your partner can legally and appropriately be in Australia in a position to lodge the 820. And since September 2026, that's very very few of you!
Why the Visitor visa is no longer the obvious first step
The Government has announced that future Visitor visas will carry a No Further Stay provision.
The Minister specifically explained that the change is intended to stop people coming to Australia as visitors and then moving onto bridging visas through partner visa or other visa applications.
That means Australian couples should no longer plan on:
Tourist visa → Australia → 820 → bridging visa
as though it were a standard immigration strategy.
What does this mean for Filipina girlfriends?
If your girlfriend is still in the Philippines, don't start by asking:
“Can she get a tourist visa?”
Start by asking:
“Are we eligible for a Prospective Marriage or Partner visa?”
If you're engaged and intend to marry, subclass 300 is probably ideal.
If you're already married or in an eligible de facto relationship, subclass 309/100 may be ideal.
If your partner is already in Australia, the situation needs to be assessed in detail by someone who knows what they are doing!
What about existing Visitor visa holders?
The Government has said that the new visitor visa policy concerns future visas and does not affect people already in Australia on their existing visas (if they are without an 8503).
Therefore, an Australian–Filipino couple should not automatically assume that someone already in Australia is in exactly the same position as someone applying for a new Visitor visa.
